Member Acceptable Use Policy

Surfside Internet strives to provide its customers with the highest quality Internet service available and at the same time respect the standards that have been created within the Internet community. To that end Surfside Internet believes that certain activities and conduct are inappropriate or abusive and will not be tolerated on Surfside Internet's network. This list is not meant to be exhaustive, but merely illustrative of examples of conduct deemed by Surfside Internet to be inappropriate and improper and therefore prohibited on Surfside Internet's network. Surfside Internet's network may only be used for lawful purposes. The transmission of material that is in violation of any federal, state or local law, or that is protected by trademark, trade secret or other intellectual property is strictly prohibited. 

Customers are prohibited from using the Surfside Internet network to transmit material that is judged by Surfside Internet to be illegal, proprietary, obscene, criminal or in some fashion inconsistent with the generally accepted standards of the Internet community. 

Surfside Internet has zero tolerance for the use of its network by anyone for the distribution of unsolicited bulk commercial e-mail transmissions. 

Surfside Internet has zero tolerance for the use of its network for the posting of messages or commercial advertisements which violate the rules, regulations, FAQ or charter of any newsgroup or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted. 

Anyone who publishes materials and information which are accessible through Surfside Internet's network is solely responsible for the content of such materials and information and is solely responsible to know and comply with all laws applicable to the publication and distribution of such materials and information. Surfside Internet does not accept responsibility for the content of the materials and information published by others which is accessible through the Surfside Internet network and does not accept responsibility for the violation of any laws resulting from such publication or distribution. 

Surfside Internet is an access provider and as such exercises no control over the content of the information passing through its network. It is expected that Surfside Internet's customers will comply with whatever rules or Acceptable Use Policies that are appropriate for those networks accessed through Surfside Internet. Each Surfside Internet customer accepts the responsibility to avoid whatever material it finds offensive. 

If any Surfside Internet customer interferes with others' use and enjoyment of the services provided by Surfside Internet, such customer shall be deemed to be in violation of this Acceptable Use Policy. 

Surfside Internet customer acknowledges compliance with Surfside Internet Access Agreement and further understands that Surfside Internet's Service is intended for periodic, active use of email, user newsgroups, file transfers via FTP, Internet chat, Internet games and browsing the World Wide Web. Surfside Internet customer further agrees not to use the service on a standby, unattended automated or inactive basis in order to maintain a connection. Surfside Internet does not offer static IP addresses. Use of a Surfside Internet connection for commercial purposes is expressly prohibited. Pinging is expressly prohibited. Accordingly, Surfside Internet reserves the right, based on network load, to terminate a customers connection to determine if the customer is in attendance. The customer is always welcome to re-connect.

Surfside Internet is solely responsible for determining if a violation of the Acceptable Use Policy has occurred. Even though Surfside Internet does not review or censor materials and information which is accessible on Surfside Internet's network or other networks which may be connected to Surfside Internet's network, if Surfside Internet becomes aware that one of its customers is in violation of this Acceptable Use Policy, Surfside Internet reserves the right to suspend or terminate service without notice. In addition, Surfside Internet reserves the right to interpret this Acceptable Use Policy in its sole discretion and to amend, revise, add or delete any provision of this Acceptable Use Policy.

By accepting the services of Surfside Internet, the customer agrees to comply with all terms and requirements of the Acceptable Use Policy.
